Q: I performed the rites of 'Umrah in Shawwal 1395 AH, and after completing them, I returned to my hometown. Since I am determined, if Allah wills, to perform the obligatory Hajj this year, 1395 AH, is the sacrificial animal (hady) obligatory for me or not? May Allah reward you with good.
A: The majority of jurists hold that the sacrificial animal (hady) is not obligatory for you, because you did not combine 'Umrah and Hajj in a single journey, as you mentioned that you returned to your country after performing 'Umrah in Shawwal 1395 AH, and did not remain in Makkah until you performed Hajj. Some jurists hold that the sacrificial animal (hady) is obligatory for you if you perform Hajj in the same year, even if you returned to your country or to a place farther away; due to the generality of the statement of Allah the Exalted:
then whoever performs 'umrah [during the Hajj months] followed by Hajj [offers] what can be obtained with ease of sacrificial animalsفَمَنْ تَمَتَّعَ بِالْعُمْرَةِ إِلَى الْحَجِّ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ
[Al-Baqarah 2:196]
, and the fatwa and practice follow the opinion of the majority that the sacrificial animal (hady) is not obligatory in that case.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
