The first, fourth, and fifth questions from Fatwa number ( 3657 )
Q1: A man performed the obligatory Hajj but left off several obligatory acts, such as leaving off entering the state of ihram from the miqat and leaving off staying overnight at Muzdalifah . Does one sacrificial animal suffice for him, or is there a sacrificial animal for each of these two obligatory acts?
A1: There is a sacrificial animal for each of these two obligatory acts. An udhiyah suffices; he slaughters it and distributes it among the poor in the Haram, and he does not eat from it. If he is unable to do so, he fasts ten days for leaving off entering the state of ihram from the miqat, and ten days for leaving off staying overnight at Muzdalifah .
Q4: Regarding the sacrificial animal for one who leaves off the obligatory acts of Hajj, what is that sacrificial animal? Is it like the sacrificial animal of tamattu' mentioned in the saying of Allah the Exalted:[Al-Baqarah 2:196] , the verse? And if so, is it permissible to give the value of the sacrificial animal and hand it to a person, for example? And if that is permissible, is it permissible for the person who receives the value of the sacrificial animal to spend it on himself or his family without buying the hady and slaughtering it?
A4: One who leaves off an obligatory act of Hajj or 'Umrah must offer a sacrificial animal. The sacrificial animal is one-seventh of a camel, or one-seventh of a cow, or a sheep that suffices as an udhiyah. He slaughters it in Makkah and divides it among the poor of the Haram. It is not permissible to give the value of the sacrificial animal in cash, because giving cash contradicts what Allah has commanded.
Q5: Is it permissible for one who must offer a sacrificial animal to delay it until he reaches his country, meaning he delays the slaughter of the sacrificial animal until he arrives in his country, for example? And when does the
permissibility of slaughtering the sacrificial animal for one who leaves off an obligatory act begin, and what is the last day for slaughtering this sacrificial animal?
A5: One who must offer a sacrificial animal for leaving off an obligatory act but is unable to do so fasts ten days: three during Hajj, and seven when he returns to his family. The time for slaughtering the sacrificial animal for leaving off an obligatory act begins from the first moment the obligatory act is left off, whether that is before the days of 'Id or after them. There is no limit to its end, but hastening it after it becomes obligatory, with the ability to do so, is obligatory. If he delays it until he reaches his country, slaughtering it in his country does not suffice. Rather, he must send it to the Haram, buy it from there, slaughter it in the Haram, and distribute it among the poor of the Haram. It is permissible to appoint a trustworthy person to do this on his behalf. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
