Fatwa number ( 12401 )
Q: My father was entrusted with performing Hajj on behalf of a person, and he was accompanied by three people from his family. His Hajj was with the people in a car for a fare, along with a group of people. The car owner left with them from 'Arafah shortly before sunset, while they were looking at the sun high on the mountain, and they were on the roof of the car. Some of the passengers called out to him, but the car owner did not respond to them. Second: they left Muzdalifah after midnight. When my father returned to his country from Hajj, he asked some
scholars of knowledge, and they informed him that he owed a sacrificial animal for each person accompanying him, since he left 'Arafah before sunset. In the second year of his Hajj, he instructed a pilgrim and said: "Slaughter four sacrificial animals for me." The person slaughtered them in 'Arafah in view of the people and distributed them among the pilgrims. When a long time, approximately (15) years, had passed since this incident, this instructed man asked a man of knowledge, and he informed him that it is not permissible to slaughter them in 'Arafah , but rather they should be inside Mina or inside Makkah . This instructed man returned the value of the sacrificial animals to us (the son of the instructed man). My father has passed away to the mercy of Allah, and the money was (240) riyals, which at that time was the value of (4) sheep. Now the value has increased, as you know. What should I do? Please inform us, may Allah reward you, and may Allah reward you with all good. And peace be upon you and the mercy of Allah and His blessings.

A: If the matter is as mentioned in the inquiry, then you must buy four sacrificial animals from sheep that are valid as an udhiyah, or four-sevenths of a camel or a cow, each of which is valid as an udhiyah, on the condition that you slaughter them in the Haram and distribute them among the poor of the Haram; for his departure and the departure of his family companions from 'Arafah before sunset. We ask Allah to accept it, and to forgive your father and his companions. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
