Q: I performed the obligatory Hajj in 1412 AH, along with my wife and my father’s wife, who suffers from a heart condition. We performed Hajj with ease and comfort, praise be to Allah, but we were unable to perform the Farewell Tawaf due to my father’s wife’s heart condition and because we were with a hired car driver and had passengers, and we did not want to cause delay for the pilgrims with us. I asked one of the shaykhs present in the Haram , and he informed us that we owed a fidyah of a sacrificial animal for each person. I have not been able to slaughter it until now because I cannot afford to support my family. Please note that my father’s wife passed away a year after Hajj, and this Hajj was on behalf of her mother. I hope you will inform me of what is obligatory for me, knowing that I am poor and have a debt of about sixty thousand riyals?
A : The Farewell Tawaf is obligatory among the obligatory acts of Hajj, and its time is when the acts of Hajj are completed and one intends to travel. If one travels without performing the Farewell Tawaf, he owes a fidyah, which is slaughtering a sheep, or one-seventh of a camel, or one-seventh of a cow, to be slaughtered in Makkah and distributed among its poor. If he does not find the means, he must fast for ten consecutive or non-consecutive days. As for the deceased,
If she left an estate, the cost of the fidyah is taken from it, and the sacrifice is performed on her behalf in Makkah. If she left no estate, it is prescribed for one of her closest relatives or others to pay the fidyah on her behalf or fast on her behalf. If two or more people share in the cost of the fidyah or in the fasting, there is no harm, and they will receive a great reward from Allah (Glorified and Exalted is He), based on the saying of the Prophet (peace and blessings be upon him):
'A'isha (Allah be pleased with her) reported Allah's Messenger (ﷺ) as saying: If anyone dies in a state (that he had to complete) some fasts, his heir must fast on his behalf.من مات وعليه صيام صام عنه وليه
