The Gift to the Only Child

Machine translationRead the Arabic original
The first question of Fatwa No. ( 14575 )
Q1: I have only one daughter, and I own a two-story house, and I have brothers. Can I give my daughter a portion of the house,
or does this gift affect the rights of the heirs and thus make the gift forbidden?

A1: If your giving of the portion of your house to your daughter is immediate and you did not intend to deprive the other heirs by taking possession of it immediately and having control over its disposal, then there is no harm in that; because this falls under the category of gifts. However, if you give it to her by bequest, this is not permissible; because there is no bequest for an heir; for it is established that the Prophet (peace and blessings be upon him) said:
There is no bequest for an heirلا وصية لوارث
. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
