Equality Between Wives in Gifts

Fatwa No. ( 6848 )
Q: This is a woman from Abi 'Aris in the Jazan region, who submits this inquiry to your eminence. Her issue is that she lived with her husband for a period of time in a narrow house, which included her husband's family as well as them, and she was patient with the narrowness of this house. Her husband promised her that if Allah opened the door for him, he would build her a spacious house separate from her father-in-law's family. Allah opened the door for her husband and his provision expanded, so he built her a spacious, independent house, and she lived in it with him for a period of time, during which she bore him four daughters. Then her husband married another wife
in another town, and was blessed with a daughter and a son from her, and he built her an independent house in her town. This first wife, the one submitting this inquiry, is now asking her husband to issue a deed for the house he built for her some time ago, after he had promised it to her for several years until Allah realized it. The husband is confused about fulfilling this request for fear of sin. Is there any sin on him if he issues a deed for her house and issues a deed for the second wife's house that he built for her in her town?

A: If the situation is as described, it is permissible for the husband to write a deed for each of his two wives for the house he built for her. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
