Q: My mother established a waqf for a mosque in our village, for food for those fasting. It is mentioned that the benefits of the waqf are currently idle, and he wishes to sell it and use the proceeds for the renovation of the mosque, given the small number of people in the mosque who need food.
A: If the matter is as the questioner described, regarding the idling of the benefits of the aforementioned waqf, and if there is no income or any other means to carry out its renovation, then the supervisor of the waqf may approach the judge in his jurisdiction to seek permission to sell a portion of the waqf to renovate the rest. As for diverting it from the purposes specified by the endower, since it is a prescribed purpose, it is not permissible to do so unless that purpose ceases to exist. Since the questioner mentioned that there are people fasting who break their fast in the mosque, but they are few in number, he should not divert the income of the waqf from the purpose designated by the endower.
