Fatwa No. ( 4955 )
Q: My father - may Allah have mercy on him - bought a shop on the main street in Hawtat Bani Tamim, and made it a public endowment (sibala) for his parents in the form of a sacrificial animal, but the shop was demolished by the municipality and we received its small compensation, which is not enough to buy a shop in its place from the municipality, amounting to (16,850 riyals). We are confused about what to do with this amount, so what is your opinion on that? Please inform us in detail what to do with this amount, and is it permissible to
use this amount for restrooms attached to mosques, or is it permissible to include it in the construction of a mosque? Knowing that one of the citizens approached us and wants the amount to include it in the construction of a mosque, but this mosque is a farm mosque where only the imam and the muezzin pray. Please inform us, may Allah reward you with good, of the best way to deal with this amount, so that we are absolved of this public endowment and no sin befalls us in that, and we have great thanks for you.
A: What you should do is strive to reinvest the aforementioned amount in a property or a share in a property in a part of the town or in any town where its value suits this amount, and to apply its income to what your father mentioned, and this should be under the supervision of the judge in the town where you intend to buy. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
