Q: I inform you that I have an aunt who entrusted me with a sum of (forty thousand riyals 40,000) and said to me: "Spend it on Hajj." I asked her about the remainder, and she said: "Do with it as you see fit." The woman is now advanced in age and senile; no answer can be obtained from her, and she does not comprehend. I am at a loss regarding the sum: do I have the right to spend it on some acts of righteousness so that the reward thereof is for her, or do I not have that right, since it is a right of the heirs after her death? I do not know her intention by her saying "Do with it as you see fit," and no answer can be obtained from her now.
A : You must perform the Hajj that your aunt instructed you to perform, if you have not already done so. You should spend on her from the remainder of the sum in a good manner if she is in need of financial support. The rest you should preserve until she dies, and it will be added to her estate. May Allah guide everyone to that which He is pleased with. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
