Praise be to Allah alone, and peace and blessings be upon the one after whom there is no prophet. And after: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the General President from the honorable judge of the al-Namasiyyah court, which was referred to the Committee by the General Secretariat of the Council of Senior Scholars, with number (4754) dated 7 \ 9 \ 1412 AH. His Excellency asked a question, the text of which is as follows. We inform you that on Monday, corresponding to 28 \ 8 \ 1412 AH, the honorable former head of the al-Namasiyyah court, the Shaykh 'Abd al-Rahman ibn 'Ali ibn Shayban, came to us with a sum of money: (thirty-nine gold pounds, a sum of one hundred and ninety-nine silver riyals, and a sum of three thousand six hundred and ninety-three Saudi riyals in paper currency of the old series, which is not currently in circulation), and he stated that this amount
is a bequest from a man named Ahmad ibn 'Abd al-Rahman al-Faqih, who is known as the Judge of Faraj, who died a long time ago. He bequeathed that it be for water for the old Grand Mosque in al-Namasiyyah only. Since the water in the aforementioned Grand Mosque has become secured without cost, on a continuous basis, and since the aforementioned Grand Mosque is newly built, we present this to Your Eminence to seek guidance from Your Eminence's fatwa regarding what we should do with this amount, especially since the amount is in old paper currency that is not currently in circulation. Is it permissible to spend it in one of the other mosques that needs repair or work for its benefits or the like, on the intention of the aforementioned bequeather? May Allah preserve you.
After the Committee studied it, it answered that based on what the legal principles require, namely that what exceeds the need of the mosque from what was allocated to it is spent in another mosque, these aforementioned amounts are to be spent in securing water for another Grand Mosque that needs it. This is because this is in accordance with the intention of the endower (may Allah have mercy on him), and we hope for him reward from Allah (Glorified and Exalted is He). And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and companions.
