Q: I was traveling and forgot to pay the fitrah. The travel was on the night of 27/9/99, and we have not paid the fitrah until now. We have a factory and a farm with workers who receive wages. Is it permissible for us to pay the fitrah on their behalf, or must they pay it for themselves?
A: First: If a person delays Zakat al-Fitr from its prescribed time while remembering it, he has sinned and must repent to Allah and make it up; because it is an act of worship, it does not become void by the passing of its time, just as prayer does not. Since the questioner mentioned that she forgot to pay it at its time, she has not sinned, but she must make it up. The reason she has not sinned is the generality of the evidence for excusing the forgetful person from sin. The reason she is obligated to make it up is the explanation previously mentioned. Second: The workers who receive wages in exchange for the work they perform in the factory and the farm are the ones who pay Zakat al-Fitr for themselves; because the original ruling is that it is obligatory upon them. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
