Q1: I purchased a piece of land in 1395 AH, and in 1398 AH I wrote a bequest making it an endowment for myself and my father, to take effect after my death. From that date until now, I have not paid zakah on it, believing that zakah is not obligatory on it after the bequest. However, one of the brothers said that it is subject to zakah. I am considering selling it and buying something better. What is the ruling on this? Do I bear any sin for delaying its zakah? And what should I do to expiate for it?
A1: If the matter is as you described, there is no zakah on it, unless you have resolved to sell it and buy something better to serve as the endowment. In that case, you must pay its zakah, and the lunar year for it begins from the time you resolved to sell it. However, merely thinking about selling it without resolving to do so does not make zakah obligatory on it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
