Q: A Yemeni man worked for me as a painter in my house. Allah decreed that he died in a car accident, and I have three thousand riyals (3000 riyals) belonging to him, but no one has come to collect the amount. I asked the
judge of our town to take the amount, but he refused on the grounds that it should remain with me until his heir arrives. More than a year has passed since his death. I asked some Yemenis who used to live with him, and they said he has a brother who will come to collect his money from his rights. A period of time passed and no one came to collect his money from his rights. I ask you to guide me, may Allah reward you, in the way that will clear my conscience and relieve me of this amount that has weighed heavily on my shoulders, may Allah preserve you.

A: You must preserve the right of this worker with you until his heir arrives, and you must verify it and hand it over to him, as long as you know that he has a brother who will come to take his brother's right from you, even if the period is long. If you invest it for him in trade or the like, that is better. If it is possible to hand over what you have of his right to the head of the court in your region, that will suffice you, and you should take a receipt from him acknowledging that he received it from you, for that is safer and easier for you.
