Q3: Is it permissible for me to give my zakah to the tribal sheikh ? Knowing that he does not deliver it to the zakah collector, and that he takes it for himself. And is it permissible if I sold it to my brother and gave the right of Allah to the collector, does anything remain due from it such that it eats and drinks with my sheep from which I extracted it?
A3 : It is not permissible to pay zakah except to the Muslim ruler if he requests it, or to the poor. As for paying it to the tribal sheikh, it is permissible if he distributes it to those who are entitled to it and the ruler has not requested it. However, if the tribal sheikh takes it for himself, it is not permissible to pay it to him. It is not permissible to pay the value of the zakah livestock except if the workers of the ruler request it, in which case you pay them the value of the livestock. As for the sheep you sold remaining with your brother along with your sheep, there is no harm in that.
