The loss of a deposit without negligence on the part of the depositary

Machine translationRead the Arabic original
The second question of Fatwa No. ( 9257 )
Q2: Iwas inIraq, and my brother gave me a sum of money to keep with me as a deposituntil he arrives fromIraq, and he knew that if this amount were found on me at the airport, it would be taken from me; because the state does not allow the export of this amount; because it exceeds the amount the state permits, so this amount was found on me and taken from me - knowing
that I had placed some of my own money with it, and my money was also taken - so what is the ruling on returning this amount?

A2: The depositary is a trustee, and if what is in his possession is lost without aggression or negligence, he is not liable for compensation. So if the matter is as you described, you are not obligated to return its value.
