All praise is due to Allah alone, and may blessings and peace be upon the one after whom there is no prophet. And after: The Permanent Committee for Scholarly Research and Ifta has reviewed the documents sent by His Excellency the Deputy Minister of Interior, No. 26/11119, dated 7/4/1392 AH, to His Eminence the Head of the Departments of Scientific Research and Ifta, Da'wah, and Guidance, which were referred to it by the General Secretariat of the Council of Senior Scholars, No. 5790/2, dated 10/4/1392 AH. After studying the documents, the Committee found among them a letter from His Eminence the Head of the Courts of al-Qunfudhah addressed to the Amir of al-Qunfudhah, No. 25/2, dated 2/1/92 AH. The content of this letter is: The Shaykh of the al-Suwaliha tribe complained about people grazing their livestock in the pasture in their lands and selling it, which causes harm to the grazing livestock. The judge stated: It is known to us that all these districts are extremely barren, and the grazing livestock have perished from hunger. Rain has fallen in the area of al-Suwaliha, and grass has grown there, which has caused the owners of livestock to flock to it in large numbers to feed their animals, due to the hunger they have suffered. There is no doubt that grazing the pasture, selling it, and restricting who may graze and sell in it is a harm and a restriction on the owners of grazing livestock.

A: After the Committee studied what was mentioned in the book of the Virtuous Head of the Courts of al-Qunfudhah, and what came in the letter from His Excellency the Deputy Minister of the Interior, the Committee wrote the following answer: The Virtuous Head of the Courts of al-Qunfudhah stated that the gathering and selling of pasture grass, and the exclusive right of those who gather and sell it, causes harm and restriction upon the owners of livestock. Therefore, if the matter is as such, those who gather and sell it are prohibited from doing so, and the grass is left for the livestock to graze on. This is in the category of prioritizing public interests over private interests. It is established from the Prophet (peace and blessings be upon him) that he said:
It was narrated from 'Ubadah bin Samit that the Messenger of Allah (ﷺ) ruled: “There should be neither harming nor reciprocating harm.”لا ضرر ولا ضرار
