Q10: Is it permissible to give from the zakah of wealth or the sacrifice on the Day of Sacrifice to a disbelieving, polytheist neighbor with whom you have no kinship?
A10: Allah has specified the recipients of zakah in the verse of Surat al-Tawbah, which is His saying, the Exalted:
Zakah expenditures are only for the poor and for the needy and for those employed to collect [zakah] and for bringing hearts together [for Islam] and for freeing captives [or slaves] and for those in debt and for the cause of Allah and for the [stranded] travelerإِنَّمَا الصَّدَقَاتُ لِلْفُقَرَاءِ وَالْمَسَاكِينِ وَالْعَامِلِينَ عَلَيْهَا وَالْمُؤَلَّفَةِ قُلُوبُهُمْ وَفِي الرِّقَابِ وَالْغَارِمِينَ وَفِي سَبِيلِ اللَّهِ وَابْنِ السَّبِيلِ
[At-Tawbah 9:60]
And the Prophet (peace and blessings be upon him) said when he sent Mu'adh to Yemen :
Inform them that Allah has made obligatory upon them—the Muslims—a charity to be taken from their rich and returned to their poorأخبرهم بأن الله فرض عليهم -المسلمين- صدقة تؤخذ من أغنيائهم وترد في فقرائهم
It is agreed upon that it is authentic, so it is not permissible to spend it on non-Muslims
except those whose hearts are to be reconciled. As for the sacrificial animal, there is no harm in giving from it to a disbelieving neighbor or a disbelieving relative; because it is a form of voluntary charity. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
