Q1: In our country, Muslims are buried in cemeteries reserved for them, but everyone who is called a Muslim is buried there, and most of them are those who do not pray and do not uphold the limits of the religion. What should be done when visiting those graves where the true Muslims and non-Muslims are not distinguished? And what is my duty if I die and am buried with people who do not pray? Should I will that I be buried with people who pray, or what should we do? Please inform us, may Allah reward you with good.
A1: It is obligatory to reserve cemeteries for Muslims, and no one else should be buried in them. The one who does not pray and dies while abandoning prayer is not buried in the Muslims' cemeteries; because the one who abandons prayer by denying its obligation is a disbeliever by consensus, and the one who abandons it out of laziness is a disbeliever according to the stronger of the two opinions of the scholars. It is prescribed for the Muslim to will that he be buried in the Muslims' cemeteries if there are cemeteries for non-Muslims in the town; out of fear that he might be buried with non-Muslims. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
