Q2: Is it permissible to bury Muslims in the graveyards of non-Muslims? The Muslims live in lands far from their graveyards, and burying them there requires transporting the deceased for more than a week, knowing that it is a recommended practice to hasten the burial of the deceased.
A2: It is not permissible for Muslims to bury a Muslim in the graveyards of disbelievers; because the practice of the people of Islam from the time of the Prophet (peace and blessings be upon him) and the Rightly Guided Caliphs and those after them has continued to separate the graveyards of Muslims from the graveyards of disbelievers, and not to
bury a Muslim with a polytheist. So this was a practical consensus on separating the graveyards of Muslims from the graveyards of disbelievers. And because of what al-Nasa'i narrated
Bashir ibn Ma'd al-Sudusi said: I was walking with the Messenger of Allah (peace and blessings be upon him) when he passed by the graves of the Muslims and said: "These people have preceded [us] in much evil." Then he passed by the graves of the polytheists and said: "These people have preceded [us] in much good."عن بشير بن معبد السدوسي قال: كنت أمشي مع رسول الله صلى الله عليه وسلم فمر على قبور المسلمين قال: لقد سبق هؤلاء شرًا كثيرًا، ثم مر على قبور المشركين فقال: لقد سبق هؤلاء خيرًا كثيرًا
, this indicates the separation between the graves of Muslims and the graves of polytheists. It is not permissible for any Muslim to settle in a non-Islamic land, nor to reside among the disbelievers. Rather, he must move to an Islamic land to save his religion from trials, so that he can establish the rituals of his religion, cooperate with his Muslim brothers in righteousness and piety, and increase the number of Muslims. This applies except to one who resides among them to spread Islam, is qualified for it and capable of it, and is one in whom it is expected that he will have an impact on others and not be overcome by their affairs. He is allowed to do so. Likewise, one who is compelled to reside among them. These people should cooperate and support one another, and they should establish special graveyards for themselves in which to bury their dead.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
