Q 2: In verse (6) of Surat al-Ma'idah, Allah the Exalted said:[An-Nisa 4:43] Does al-malamsah refer to shaking hands and the like, or to specific sexual intercourse? It is known that the vast majority of us are followers of the Shafi'i school of jurisprudence.
A 2: Praise be to Allah alone, and blessings and peace be upon His Messenger, his family, and his Companions.. And to proceed:
The intended meaning of "touching" in the verse from Surat al-Nisa is specific intercourse. Ibn Abbas interpreted it as sexual intercourse, and it was narrated from Ali, Abu ibn Ka'b, Mujahid, Tawus, al-Hasan, Ubayd ibn 'Umar, Sa'id ibn Jubayr, al-Sha'bi, Qatadah, and Muqatil ibn Hayyan to that effect. And Ibn Mas'ud (may Allah be pleased with him) and a group of scholars said: "The intended meaning is the actual touching of any of her body parts," and they considered this to invalidate the ablution. The first opinion is more correct; because it is established from him (peace and blessings be upon him) that he kissed some of his wives and then prayed without performing ablution, and because the original state is the integrity of purity, so it is not invalidated except by a known invalidator established by the evidence of the Shari'ah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
