Fatwa number ( 6972 ):
Q: A man prays and fasts and performs all the pillars of Islam, and despite all of this, he calls upon other than Allah , for he seeks nearness to Allah through the awliya (close friends of Allah), takes refuge in them, and believes that they are capable of bringing benefits and warding off harms. Inform us, may Allah reward you with good, whether their children who are monotheists in Allah and do not associate anything with Allah inherit from them, and also, what is their ruling?
A: Whoever prays and fasts and performs the pillars of Islam, but calls for aid from the dead and the absent, and from the angels and the like, is a mushrik (one who associates partners with Allah). If he is advised and does not accept, and persists in that until he dies, he is a mushrik who commits major shirk (associating partners with Allah), which takes him out of the religion of Islam. Therefore, he is not washed, nor is the funeral prayer (janazah) performed over him, nor is he buried in the graves of Muslims, nor is forgiveness sought for him, nor do his monotheist children, or his monotheist parents, or his monotheist brothers, or the like of them inherit from him
who are Muslim, due to their difference in religion; for the Prophet (peace and blessings be upon him) said:
A Muslim may not inherit from an infidel nor an infidel from a Muslim.لا يرث المسلم الكافر، ولا الكافر المسلم

narrated by al-Bukhari and Muslim . And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
