The second question of Fatwa No. ( 6799 ):
Q2: A woman sought refuge in Allah from her husband, or the reverse. What is the ruling?
A2: It is obligatory to grant refuge to one who seeks refuge in Allah, in order to honor Him (Mighty and Majestic). Abu Dawud and al-Nasa'i narrated with a sound chain from Ibn 'Umar (may Allah be pleased with them both) who said: The Messenger of Allah (peace and blessings be upon him) said:
Whoever asks for something in the name of Allah, give it to him; whoever seeks refuge in Allah, grant him refuge; whoever invites you, respond to him; and whoever does you a favor, reward him. If you find nothing with which to reward him, then pray for him until you see that you have rewarded him.من سأل بالله فأعطوه، ومن استعاذ بالله فأعيذوه، ومن دعاكم فأجيبوه، ومن صنع إليكم معروفًا فكافؤوه فإن لم تجدوا ما تكافؤوه فادعوا له حتى تروا أنكم قد كافأتموه
. This applies if the one seeking refuge is not obligated to do what he sought refuge from. However, if he is obligated to do what he sought refuge from, such as a debt, the right of a spouse, retaliation, or the like, then it is not obligatory to grant him refuge. It is obligatory for him to fulfill the right owed to him, unless his opponent forgives his right; this is to reconcile the evidence. And success is from Allah. May Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
