Fatwa number ( 8224 ):
Q: I read in the magazine (Qafilat al-Zayt), issue number 120, published in Dhul-Hijjah of the year 1404 AH, under the title: Banu Sa'd and al-Harith and Thaqif and Banu Malik , where I read in that article, on page twenty-eight of the magazine, in the words of Shaykh Zayd ibn Ahmad ibn Muhammad al-Harithi , the judge of the Banu Malik court, that when the delegations of the tribes came to the Prophet (peace and blessings be upon him), among them was the delegation of al-Harith, who were the Azd , led by, he said: Suwayd ibn Harithah, so when they were before the noble Messenger (peace and blessings be upon him), he said: "Who are the people?" Their leader, Suwayd , said: "We are believers." He (peace and blessings be upon him) said: "Every statement has a truth, so what is the truth of your faith?" He said, Suwayd : "Fifteen characteristics: ten of which your messengers ordered us to believe in, meaning: the pillars of faith and the pillars of Islam, and five by which we are characterized in our pre-Islamic age of ignorance, and we are upon them, unless you dislike something of them." He said (peace and blessings be upon him): "What are the five?" Suwayd said: "Steadfastness in the place of encounter, and refraining from gloating over
the enemies, and patience in affliction, and contentment with the divine decree, and gratitude in times of ease. He (peace and blessings be upon him) said: "What a set of five! And I will add five for you, so that you return from me with twenty: Do not accumulate what you do not eat, do not build what you do not inhabit, do not compete in anything from which you will be departing tomorrow, fear Allah to Whom you will return, and desire what you are advancing toward, in which you will abide." And when the people left, the Prophet (peace and blessings be upon him) said: "Jurists and wise men, who nearly became prophets due to their jurisprudence." With my request, I am attaching a copy of the aforementioned magazine. I ask your eminence to inform me of the extent of the correctness of what is mentioned above, and whether it is a hadith issued by the noble Messenger (peace and blessings be upon him), as it is stated and written? And I have much thanks for you, and may Allah write for you reward, recompense, success, and guidance
A: What came in the story in your question of the conversation that took place between Suwayd , the leader of the delegation, and the Prophet (peace and blessings be upon him), and the saying of the Prophet (peace and blessings be upon him) about the delegation, "Jurists and wise men, who nearly became prophets due to their jurisprudence," was mentioned by Ibn Kathir in his account of the arrival of the Azd delegation to the Messenger of Allah (peace and blessings be upon him), volume 5, page 106, of the book [al-Bidaya], and its beginning was mentioned by Ibn Hajar in the biography of Suwayd al-Azdi in the book [al-Isabah], and its chain of narration rests on 'Uqbah ibn Yazid ibn Suwayd al-Azdi from his father from his grandfather Suwayd al-Azdi , and 'Uqbah : is unknown,
so it is not used as evidence; for what Ibn Hajar mentioned in [Lisan al-Mizan], he said: 'Uqbah ibn Yazid ibn Suwayd from his father from his grandfather: is not known, and he brought a denounced report, so it is not used as evidence. And thus, the report is not valid. And success is from Allah. And may Allah send prayers upon our Prophet Muhammad, and his family and his Companions and peace.
