Fatwa No. ( 4950 ):
Q: A citizen came to us claiming that it is permissible to swear by the Qur'an, and that he swears by the mushaf without caring. We advised him, but he did not accept. What is your opinion on this?
A: It is permissible to swear by Allah and His attributes. The Qur'an is the speech of Allah, which is one of His attributes, so it is permissible to swear by it. If the man mentioned intends to swear by the speech of Allah, this is permissible. If he intends to swear by the paper of the mushaf and the ink with which it was written, this is not permissible; because the paper and ink are created things, and it is not permissible to swear by a created thing; due to the saying
of the Prophet (peace and blessings be upon him):
Whoever has to take an oath should swear by Allah or remain silent.من كان حالفًا فليحلف بالله أو ليصمت
Sahih al-Bukhari 2679
. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
