The Third Deviation from the Sunnah: The Hadith on Making a Condition in Hajj and the Permissibility of Breaking the State of Ihram.

Machine translationRead the Arabic original
The Shaykh : Then he said, thirdly, the hadith regarding making a condition in Hajj and the permissibility of breaking the state of ihram. This is a very important benefit for every pilgrim or one performing 'Umrah. It is that when entering the state of ihram for Hajj or 'Umrah, immediately after the talbiyah, one should say, "O Allah, my place of untying is where You have detained me." If he says this phrase and makes this condition with his Lord, a very important matter follows from it. Although it is from the good deeds and from the very important dispensations, and it results in the dropping of some of the legal obligations, people are unaware of it. Why? Because most of the schools of jurisprudence have not adopted this ruling. What is the benefit of this condition? If a pilgrim performs Hajj and then is prevented from completing it, by the explicit text of the Qur'an:
But if you are prevented, then [offer] what can be obtained with ease of sacrificial animals فَإِنْ أُحْصِرْتُمْ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ
[Al-Baqarah 2:196]
, then he must perform Hajj in the following year to make up for this Hajj that was delayed and from which he was prevented from completing it, even if he had already performed the Hajj of Islam. In that case, this Hajj of his would be voluntary, but since he was unable to complete it, he owes a sacrificial animal and he must perform Hajj in the following year. However, if he said, "O Allah, my place of untying is where You have detained me...," then he owes nothing. You see that this is at the height of ease, and yet people are unaware of it. And the result of this unawareness is not that these two obligations—repeating the Hajj and dropping the sacrificial animal—are dropped from them, but rather that sins follow, because many of these people do not apply the ruling. They do not resume the Hajj, they do not make it up, and they do not slaughter. They will say to you, "I am excused; I was ill, for example, or I was prevented by robbers, or something similar." This is the third point.
