The questioner: His EminenceThe Shaykh : , Peace be upon you and Allah's mercy and blessings, and may Allah welcome you. As for what follows:
A woman asks about her deceased father who had two slaves in his debt. He died in a car accident and did not free a slave or fast for two consecutive months because they were ignorant of this matter. Knowing that he paid their blood money, is it permissible for me to fast two months for each soul? Is it possible for me to share this with my relatives? Is it possible to feed sixty poor people for each soul?
The Shaykh: Is it the son?
The questioner : Oh?
The Shaykh: Is it the son who is asking? The son?
The questioner: The question is from the woman whose father passed away.
The Shaykh: Okay; the son of the deceased; the woman, I mean?
The Shaykh: Yes, it is permissible for her to do so; because it is authentically reported from the Prophet (peace and blessings be upon him) that he said:Sahih Muslim 1147 , so the scholars differed regarding this fasting; is it fasting like Ramadan and other fasts, or is it not fasting like Ramadan?
And the most correct opinion, to which we have inclined after studying the arguments of both groups, is that this fasting mentioned in this hadith is not fasting like Ramadan. Therefore, it includes the expiation fasting mentioned in this hadith;Sahih Muslim 1147 , likewise, freeing a slave, and freeing a slave on behalf of fathers and mothers is like charity, or it is a type of charity; so it is obligatory for the guardian of the deceased, whether male or female, to carry this out. If he is unable to do so, and some of his relatives or distant kin assist him, that is permissible, if Allah wills - the Exalted -.
