The questioner : The questioner says: My uncle arrived in the state of ihram for 'Umrah from the miqat, and his wife said to him: "Take off the ihram clothes until you go to the Haram." So he did, then he put the ihram clothes back on today after he went out to al-Hudaybiyyah and completed his 'Umrah. Is he required to do anything? And is Jeddah level with the miqat of the people of Sham and Egypt if they come by sea?

The Shaykh : If this man was ignorant, then he owes nothing. But if he knew and intentionally took off the ihram clothes and put on the customary known clothes, then he has done wrong and made a mistake. According to the majority of scholars, he must slaughter a fidyah (ransom payment) to be distributed to the poor, or fast for three days, or feed six poor people, giving each poor person half a sa' (a dry measure of about 3 kg). This fidyah is called by the scholars the fidyah of harm. This is the ruling regarding his wearing of the garment. As for the ihram, it is obligatory for one who passes by a miqat intending Hajj and 'Umrah to enter the state of ihram from that miqat, and it is not permissible for him to delay. If he passes, for example, by Rabigh, which is the miqat of the people of Sham, Egypt, and the Maghrib, and he passes by this miqat intending 'Umrah, then he must enter the state of ihram from it, and it is not permissible to delay the ihram until Jeddah. Some people have erred in saying that the one who comes by plane enters the state of ihram from Jeddah. The error in this is what is established from 'Umar ibn al-Khattab (may Allah be pleased with him) when the people of Basrah and Kufah came to him and said: "O Commander of the Faithful:
The Prophet (peace and blessings be upon him) designated Qarn, meaning Qarn al-Manazil, for the people of Najd, and it is off our road. So 'Umar (may Allah be pleased with him) said: "Look for what is level with it on your road." إن النبي صلى الله عليه وسلم وقّت لأهل نجد قرنا يعنون قرن المنازل وإنها جور عن طريقنا فقال عمر رضي الله عنه : انظروا إلى حذوها من طريقكم
" And the meaning of "level with it" means what is opposite to it. This indicates that if a person is level with the miqat, even in a plane, he must enter the state of ihram from it, and it is not permissible for him to delay the ihram until he reaches Jeddah. If you come, for example, from the direction of Madinah by plane, from where do you enter the state of ihram? When you are level with Abi 'Ara, meaning al-Hudaybiyyah. If you come from the direction of Qarn al-Manazil by plane, from where do you enter the state of ihram? When you are level with Qarn al-Manazil. And if you come by plane from the direction of Yemen and are level with Yalamlam, you must enter the state of ihram from it, and so on. It is not permissible to delay the ihram until you land in Jeddah.
