Question: My wife and I currently reside in Yemen, and to this day we do not own a residence in our country. I possess a sum of money, and we have not yet performed the obligatory Hajj. Is it obligatory for us to perform Hajj immediately, given that we are financially capable, even though we do not own a house? Or should we first purchase a residence to live in, and then, if we are able to perform Hajj, we do so; otherwise, we postpone it until we are able?

Answer: It is well known that Allah (Glorified and Exalted is He) made Hajj obligatory upon the one who is able,Allah the Exalted said:
And [due] to Allah from the people is a pilgrimage to the House - for whoever is able to find thereto a wayوَلِلَّهِ عَلَى النَّاسِ حِجُّ الْبَيْتِ مَنِ اسْتَطَاعَ إِلَيْهِ سَبِيلًا
[Surah Al-Imran: 97], and this is by possessing provisions and a mount, such that these provisions and this mount are in excess of what is sufficient for his housing and his expenses, and the expenses of his children, until he returns. If the amount in your hands does not cover your essential needs, which include
housing, then Hajj is not obligatory upon you until you have secured your essential needs. If you have any surplus in your hands, then perform Hajj. Hajj is not obligatory upon you, nor is it required of you, until you have money in excess of what is sufficient for your housing and your sustenance, and the sustenance of your children and those whose maintenance is obligatory upon you.
