I had intercourse with my wife after entering the state of ihram for 'Umrah, while combining it with Hajj. Does this invalidate the Hajj this year, or only the 'Umrah? Do I return to the miqat to perform a second 'Umrah, and is there nothing wrong with my Hajj? What is the expiation for this act?

The questioner : Since I had intercourse with my wife after entering the state of ihram for 'Umrah, while combining it with Hajj, does this invalidate the Hajj this year, or only the 'Umrah? Do I return to the miqat to perform a second 'Umrah, and is there nothing wrong with my Hajj? What is the expiation for this act?
The Shaykh : Praise be to Allah. As for his Hajj, it is not invalidated because this 'Umrah is separate from it, having its own independent ihram and exit from the state of ihram, and so is the Hajj. His Hajj is valid and there is nothing wrong with it. As for the 'Umrah that he invalidated, it is obligatory for him to make it up. If he has already made it up before the Hajj, and he entered the state of ihram from the miqat in place of the one he invalidated, then he has fulfilled what is required of him. In this case, he must offer a sheep, other than the sheep of the hady for tamattu'. He must offer a sheep to be slaughtered on account of his intercourse, because intercourse during 'Umrah, as stated by the scholars, requires a sheep, or feeding six poor people, with each poor person receiving half a sa' (a dry measure of about 3 kg), or fasting for three days.
The questioner : Yes.
The Shaykh : The principle with them is that whatever requires a sheep due to intercourse or direct contact is equated with the expiation for harm.
The questioner : Yes.
The Shaykh : And the expiation for harm allows a person to choose between three things, as Allah Mighty and Majestic said:[Al-Baqarah 2:196] And the Prophet (peace and blessings be upon him) clarified that the fasting is for three days, and the charity is feeding six poor people, with each poor person receiving half a sa' (a dry measure of about 3 kg).
The questioner : Yes.
The Shaykh : And as for the sacrifice, it is slaughtering a sheep.
The questioner : Yes, meaning, whoever did what the listener Shu'ayb Shu'ayb al-Ghazwani did, he must return to the miqat.
The Shaykh : He must return from the miqat from which he entered the state of ihram for the 'Umrah that he invalidated, because making up an act mirrors its original performance.
The questioner : Yes.
The Shaykh : So long as it is a make-up, the make-up is performed exactly in the manner of the original performance.
The questioner : Yes, the listener Shu'ayb Shu'ayb did not perform 'Umrah, meaning, from his message, because he is asking now, and most of it has passed, meaning, the Hajj has passed. Is it required of him?
The Shaykh : It is required of him to do it now.
The questioner : It is required of him to do it...
The Shaykh : It is required of him to do it now and slaughter the sheep, which is the blood of compensation, if he wishes. Or if he wishes, he feeds six poor people, with each poor person receiving half a sa' (a dry measure of about 3 kg). Or if he wishes, he fasts for three days.
The questioner : We hope, if Allah wills, that Shu'ayb has listened to the answer of the honorable Shaykh Muhammad ibn Salih al-Uthaymeen to his question.
The Shaykh : On the occasion, I also advise my Muslim brothers to be patient, for the period is short and simple.
The questioner : Yes.
The Shaykh : And they did not enter into Hajj and 'Umrah except while committed to the rulings of Allah the Exalted in them.
The questioner : Yes.
The Shaykh : So a person should be patient and seek reward, for Hajj is a type of jihad. As for a person not restraining himself from what Allah has forbidden during this short period, this is a deficiency in his resolve, his intellect, and his religion.
The questioner : Yes.
The Shaykh : So it is obligatory for him to be patient and seek reward from Allah Mighty and Majestic.
The questioner : Yes.
The Shaykh : Yes.
