The Shaykh : Now the author (may Allah have mercy on him) presents another chapter, which is a sub-branch of the previous chapter, where he says: "Chapter: The elder begins the speech and the question." This is also part of honoring and respecting the elder, by making room for his speech over that of others. He cites as evidence for this a hadith that is somewhat lengthy and contains rare jurisprudence that has not reached the ears of many students of knowledge, let alone others, so it is hoped that you will pay attention to it: He narrates with his authentic chain.
From Rafi' ibn Khadij and Sahl ibn Abi Hathmah, that they reported that Abdullah ibn Sahl and Muhayisah ibn Mas'ud went to Khaybar, and they separated among the date palms. Abdullah ibn Sahl was killed. Then Abd al-Rahman ibn Sahl, Huyaybah, and Muhayisah, the two sons of Mas'ud, came to the Prophet (peace and blessings be upon him). They spoke about the matter of their companion, and Abd al-Rahman began, and he was the youngest of the group. The Prophet (peace and blessings be upon him) said to him:
Honor the elder كَبِّر الكُبَر
.
Yahya said, and he is one of the narrators of the hadith, explaining the saying of the Messenger
Honor the elder كبِّر الكبر
: Yahya said, "To weigh the speech of the elder": This is the meaning of
Honor the elder كبِّر الكبر
.
They spoke about the matter of their companion, and the Prophet (peace and blessings be upon him) said:
Will fifty of you take an oath whereby you will have the right to receive the blood money of your murdered man," (or said, "..your companion") أَتستَحِقُّون قَتِيلكُم - أَو قَالَ - صَاحِبكُم بَأيمَان خَمسين مِنكُم ؟
Sahih al-Bukhari 6142, 6143
. They said: "O Messenger of Allah, it is a matter we did not see." He said:
The Jews will exonerate themselves by the oaths of fifty of them. فَتُبرِئُكم يَهود بَأيمانِ خَمسينَ مِنُهم ؟
Sahih Muslim 1669b
. They said: "O Messenger of Allah, they are a disbelieving people." So the Messenger of Allah (peace and blessings be upon him) paid their blood money from his own side.
I, unfortunately, feel that this clear Arabic speech is like foreign speech in that it is not understood in most of its aspects; therefore, let us return to the beginning of the hadith and explain the ambiguous words or phrases in it, and then we will discuss two issues: the first related to the chapter, and the other related to the incident as a legal ruling. This hadith revolves around two well-known Companions, one of whom is Rafi' ibn Khadij and the other is Sahl ibn Abi Hathmah: These two reported this story, which is that Abdullah ibn Sahl and Muhayisah ibn Mas'ud went to Khaybar: They came to Khaybar, of course, in the time of the Messenger (peace be upon him), first, and after the conquest of Khaybar by force and the reconciliation of the Messenger (peace be upon him) with the Jews, on the condition that they remain there and cultivate their land, and that the produce be shared equally between the Messenger (peace be upon him) and the Jews. This means that Khaybar, after this reconciliation, is considered a piece of Islamic territory, but its inhabitants are Jews working with the approval of the Messenger (peace be upon him) and under known conditions between them. So these men went to Khaybar and entered the date palms, meaning the date palm trees, and they began to move among the trees. They separated among the date palms, and Abdullah ibn Sahl was killed: One of the Companions who were with these men was killed. He was found dead at the base of a tree, usually like an olive tree. You know olive trees; they dig a hole around the base of the tree so that the water covers it and the tree drinks well. So they found their companion, this Abdullah ibn Sahl, dead in one of the basins that usually surround date palm trees. Then Abd al-Rahman ibn Sahl, who was the brother of the killed man, and Huyaybah and Muhayisah, which are Arabic names, both sons of Mas'ud, came to the Prophet (peace and blessings be upon him), who was naturally in Madinah.
