The Shaykh : If the delay of the 'aqiqah to after the twenty-first day is not due to inability but due to ability, this is a man who has left what Allah has made obligatory upon him regarding slaughter; so he is sinful, and there is no way to make up for what he missed; because Allah (Mighty and Majestic) has set a specific time for this 'aqiqah, like any act of worship that is timed by its known times prescribed by the Shari'ah. So if the Muslim who is accountable does not care about this timing prescribed by the Shari'ah, Allah (Mighty and Majestic) does not care about him or about anyone who opposes in a manner similar to his opposition. But if it is due to inability, then when he is able, he must hasten to perform what Allah has prescribed for him as the obligatory 'aqiqah; because Allah (Mighty and Majestic) says:
Allah does not charge a soul except [with that within] its capacity لَا يُكَلِّفُ اللَّهُ نَفْسًا إِلَّا وُسْعَهَا
[Al-Baqarah 2:286]
.
As for the evidence, it is well known; because the Messenger (peace be upon him) said:
Every boy is pledged by an 'aqiqah that is slaughtered for him on his seventh day كلُّ غلامٍ مرتهنٌ بعقيقة تُذبح عنه يوم سابعه
, and in some hadiths:
So let them pour out blood for it فأهريقوا عنه دمًا
, then there was a concession that if the slaughter does not become easy for him on the seventh day, then it is on the fourteenth, and if it does not become easy, then on the twenty-first. After that, the timing prescribed by the Shari'ah ends.
So the matter differs between the one who is able but does not do it, in which case he is sinful, and there is no way to make up for what has passed, and the one who is not able, in which case the 'aqiqah becomes obligatory upon him when he becomes able. As for the adult man whose guardian did not perform the 'aqiqah for him, he performs it for himself following the example of the Prophet (peace be upon him); for when prophethood reached him, he performed the 'aqiqah for himself (peace and blessings be upon him).
