Have you not heard our words before? The disbeliever’s Hajj is not valid, and it is not permissible for him to enter the boundaries of the Haram.because of His saying, the Exalted: [At-Tawbah: 28] So the one who does not pray is not permitted to enter the boundaries of the Haram.Meaning: If he is within the boundaries of the Haram, it is not permissible for him to enter it; he is to be prevented from doing so.
If he is with a group and he does not pray, and his group knows that he does not pray, it is obligatory for them, when they approach the boundaries of the Haram, to make him dismount. If he refuses, they should speak to the authorities about him; because he is a disbeliever, and it is not permissible for a disbeliever to enter Makkah, nor is his Ihram for Hajj valid, nor his Hajj, nor his fasting, until he returns to Islam and prays.
