A man who never prays, neither in the mosque nor at home, is a disbeliever and an apostate. He must be called to pray, or else he must be killed as a disbeliever.Meaning: He is an apostate, and his Hajj is not valid. Even if he performs Hajj on behalf of someone else, it is not valid because he is a disbeliever.And Allah the Exalted said:
And what prevents their expenditures from being accepted from them but that they have disbelieved in Allah and in His Messengerوَمَا مَنَعَهُمْ أَنْ تُقْبَلَ مِنْهُمْ نَفَقَاتُهُمْ إِلَّا أَنَّهُمْ كَفَرُوا بِاللَّهِ وَبِرَسُولِهِ
[At-Tawbah: 54] Although the benefit of their expenditures extends to others, they are not accepted from them because of their disbelief. And whoever knows that this man is a disbeliever must compensate him for the money he gave him and perform Hajj in place of this Hajj if it was an individual obligation.And if it was voluntary, then nothing is required of him. That is to say: If he wishes, he may appoint someone to perform Hajj on his behalf, or he may perform it himself, or he may not perform it.
