The Shaykh: This man performed Hajj as a combined pilgrim, circumambulated for arrival as soon as he arrived in Makkah, and performed the sa'y, then after standing at 'Arafah and Muzdalifah, he performed the farewell circumambulation and departed,We say: He still has the farewell circumambulation (Tawaf al-Ifadah) remaining, which is a pillar without which Hajj is not completed, and he remains in the state of ihram regarding the second release from ihram. Consequently, he must not approach his wife if he has one, and it is obligatory for him to complete his Hajj as long as the month is still ongoing. He must now travel to Makkah, and it is better for him to perform 'Umrah when he passes the miqat, entering ihram from the miqat, circumambulating, performing the sa'y, and shortening his hair, then performing the farewell circumambulation (Tawaf al-Ifadah).

As for having intercourse with his wife, I see that we should punish him with the harshest penalty; because the man is negligent, it has been three years and he did not ask, and this is a problem,But according to the opinion: That the ignorant person is not obligated to do anything, we say: If he repents to Allah and amends his conduct, then he is not obligated to do anything other than what I mentioned.
