Q3: A man performed Hajj with his mother, and his mother was disabled and could not walk except in a cart. They were with a group of pilgrims, and they left the completion of Hajj along with the farewell tawaf . At the time of the farewell tawaf, headscarves and carts were not allowed to enter the Haram . The group had a scheduled time to return, and fearing they would miss the group, they asked one of the scholars in the Haram about it, and he answered: There is no harm in returning to the town they came from, but it is obligatory to return to complete the Hajj, and they were still in the state of ihram regarding intercourse. The woman returned after a week and completed her Hajj, knowing that this was her first Hajj. Is this permissible, and what is your opinion regarding the man who accompanied his mother? He had fulfilled his obligation a year prior, but his mother's circumstances did not allow him to complete his Hajj. He returned to his town and was unable to return to Makkah . Knowing that he is married and has children. Please inform us, may Allah reward you, and may you remain.

A3: If this woman who traveled before the tawaf of ifadah returned to Makkah and performed the tawaf of ifadah, she has fulfilled what is required of her, and praise be to Allah. But if she delayed after the tawaf of ifadah in Makkah , she must perform the farewell tawaf; if she left it, she owes a fidyah. If she traveled immediately after the tawaf of ifadah, she owes nothing. Likewise, her companion who traveled to his town with her before the tawaf of ifadah is required to do what is required of her. It is not permissible for him to have intercourse with his wife until he performs the tawaf of ifadah; if he has intercourse before that, he owes a fidyah—and so it is for her if intercourse occurs before the tawaf. The fidyah is a head of sheep that is sufficient for the udhiyah, or one-seventh of a camel, or one-seventh of a cow, to be slaughtered in Makkah and distributed to the poor.
