During the Hajj season, people perform tawaf on the roof of al-Masjid al-Haram, which narrows from the side of the Sa'y to six meters, forcing people to go out onto the roof of the Sa'y. Is there any impediment to this? What is the reasoning and what is the evidence?
The Sa'y is not part of al-Masjid al-Haram; rather, it is outside of it. For this reason, it is permissible for a menstruating woman to wait for her family in the Sa'y, but she does not enter the mosque. It is not permissible for a person in i'tikaf in al-Masjid al-Haram to go out to the Sa'y, because the Sa'y is outside the mosque. If that is the case, then it is not permissible to perform tawaf on the roof of the Sa'y, because it is outside the mosque. However, if a dire necessity arises, such as severe crowding where a person is unable to continue his sa'y and tawaf, I hope there is no harm in it. The area of the Sa'y on the roof is narrow, so people may come, for example, when the area before it is already full. When they arrive from that direction, it becomes cramped for them, forcing a person to go down to the roof of the Sa'y.I say: In this case, it is a dire necessity, and I hope there is no harm in it.

As for the evidence that it is not permissible to perform tawaf in the Sa'y or outside al-Masjid al-Haram, Allah the Exalted said:
perform Tawaf around the ancient House."وَلْيَطَّوَّفُوا بِالْبَيْتِ الْعَتِيقِ
[Al-Hajj: 29] If a person performs tawaf from behind the mosque, he has performed tawaf around the mosque, not around the House, so his tawaf is not valid.
