Q: In the year 1418 AH, I performed the Tawaf al-Ifadah and the Farewell Tawaf on the upper level of the Sacred Mosque, because the congestion during Hajj that year was severe. Due to the heavy congestion, and because the part of the upper level is narrow on the side facing the Sa'i area ( al-Safa and al-Marwah ), many pilgrims are forced to descend to the Sa'i area, which is one meter lower than the upper level, and walk a few meters in it before entering again (a rise of one meter). I was confused by what I read that the Sa'i area is considered by the jurists to be outside the Haram, and consequently that the Tawaf is not valid; because part of it is outside the Haram.
