The fifth: The emission of semen through desire (by action) means that a person emits semen through desire, that is, by his own action, whether by direct contact, kissing, or otherwise. This is not a point of agreement among the scholars.Some scholars say: It does not break the fast; because there is no explicit evidence for it, and the original ruling is the validity of the fast and that it is not invalidated except by explicit evidence.

But it can be said: The evidence is the saying of the Prophet (peace and blessings be upon him) in the authentic hadith which he narrates from Allah the Exalted, that Allah said regarding the fasting person: (He leaves his food, drink, and desire for My sake) Since semen is a desire, this is why the pleasure of intercourse is not called anything other than emission. And it indicates this that the Messenger (peace and blessings be upon him) said: (And in the intercourse of one of you is charity – meaning that intercourse with his wife is charity –They said: Does one of us fulfill his desire and receive a reward for it?He said: Yes, do you think if he placed it in what is forbidden, would he bear a sin?They said: Yes,He said: Likewise, if he places it in what is lawful, he receives a reward) This is the opinion of the majority of scholars: that it breaks the fast by emission through desire if it is by his action. There is no doubt that this is the more cautious position, and that it is not permissible for a person who is fasting an obligatory fast to do that,Meaning: that he emits through desire by his action, and if he does so, let him make it up.

And we say: The emission of semen through desire is out of caution against a situation where a person is afflicted with an illness and semen comes out of him, or he falls from a wall and semen comes out with the fall; this does not break the fast.

And we say: By his action, out of caution against a situation where a person thinks about intercourse and emits; he does not break the fast by that, due to the saying of the Prophet (peace and blessings be upon him): (Indeed, Allah has pardoned my ummah for what their souls suggest to them, as long as they do not act upon it or speak of it) But if, while thinking, he moved his penis and emitted by this movement, does he break the fast or not? He breaks the fast; because this is by his action, so it is an act of stimulation in reality.
