The second question of Fatwa No. ( 18540 )
Q2: I went to perform the obligatory Hajj for the year 1414 AH, and Allah willed that I fell ill on the eighth day, while I was in the state of ihram in Mina. As a result, I was admitted to the hospital, and I was unable to complete the rites of Hajj. I did not leave the hospital until after the period of Hajj had ended. I ask Allah the Most High, the Almighty, and then I ask you, your Excellency, to guide me on what I should do? May Allah reward you with the best reward, and may Allah reward you, and may Allah preserve you, care for you, and guide your steps to doing good.
A2: If a person is prevented from performing Hajj due to an illness that prevents him from performing the rites, and he had made a condition at the beginning of his ihram that his place of exit is where I am prevented, then it is permissible for him to exit the state of ihram absolutely, and he owes nothing. If he did not make a condition, it is permissible for him to exit the state of ihram according to the correct opinion of the scholars, but he must slaughter a sacrificial animal in the Haram before exiting the state of ihram. If he is unable to do so, he must fast for ten days; because he is considered a person who was prevented. If he is able
to make his ihram an 'Umrah, he must circumambulate, perform sa'y, and shorten his hair, then exit the state of ihram. It is obligatory for him to do so, and he must make up the Hajj in the future if he is able to do so, and he must offer a sacrificial animal with his Hajj that is sufficient for the 'Id sacrifice. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
