The questioner : He says: An elderly man who is unable to perform the obligatory Hajj due to his incapacity asked one of his relatives to perform Hajj on his behalf. He gave him money, and gave him the necessary funds for the Hajj. However, this appointed person committed some sins and disobedience during his Hajj. What is the ruling on this Hajj for the elderly man? Is it valid, or does any of the sin of those sins and disobedience attach to him?

The Shaykh : The Hajj is valid as long as he did not commit a prohibited act that invalidates it. As for the sins committed by this pilgrim, their sin is upon him, and nothing of that sin is upon the elderly man for whom he performed the Hajj, because he did not commit them, and certainly he does not approve of them. Thus, the sin is upon the one who committed them. It is obligatory for the one who accepts to act on behalf of another to fear Allah the Mighty and Majestic, and to fulfill the trust as it should be. Indeed, Allah the Exalted says:
Indeed, Allah commands you to render trusts to whom they are due and when you judge between people to judge with justice. Excellent is that which Allah instructs you. Indeed, Allah is ever Hearing and Seeing. إِنَّ اللَّهَ يَأْمُرُكُمْ أَنْ تُؤَدُّوا الْأَمَانَاتِ إِلَى أَهْلِهَا وَإِذَا حَكَمْتُمْ بَيْنَ النَّاسِ أَنْ تَحْكُمُوا بِالْعَدْلِ إِنَّ اللَّهَ نِعِمَّا يَعِظُكُمْ بِهِ إِنَّ اللَّهَ كَانَ سَمِيعًا بَصِيرًا
