The questioner : He says: Your Eminence, a man fell ill a year and a half ago with a severe illness caused by a heatstroke. He has not performed Hajj, and he fears the intense sun. Is it permissible for him to appoint someone to perform Hajj on his behalf? Even though he is now in good health, the doctors tell him to be careful of the sun.

The Shaykh : Yes, I say that it is obligatory for him to perform Hajj himself, and it is not permissible for him to appoint someone as long as it is the obligatory Hajj. However, he should go and enter the state of ihram from the miqat and cover his head, as Allah the Exalted said:
And whoever among you is ill or has an ailment of the head [making shaving necessary must offer] a ransom of fasting [three days] or charity or sacrifice فَمَنْ كَانَ مِنْكُمْ مَرِيضًا أَوْ بِهِ أَذًى مِنْ رَأْسِهِ فَفِدْيَةٌ مِنْ صِيَامٍ أَوْ صَدَقَةٍ أَوْ نُسُكٍ
[Al-Baqarah 2:196]
He goes and enters the state of ihram and covers his head with a ghutrah and a taqiyah, and feeds six poor people, giving each poor person half a sa' (a dry measure of about 3 kg), or fasts for three days, or slaughters a sheep and distributes it to the poor in Makkah. So the matter is easy, and praise be to Allah. Yes.
