The Shaykh : Praise be to Allah.

The questioner : My master, I have been trying to speak with you for several days. Glory be to Allah, I was unable to.

The Shaykh : May it be well.

The questioner : I have a question, if Allah wills, regarding a man who can stay on a mount, but he is suffering from an illness such that if he walks ten to twenty steps, he experiences shortness of breath, and if he goes to Hajj, it would be a great hardship for him.

The Shaykh : Yes.

The questioner : Yes, so is it permissible for him to appoint another person to perform Hajj on his behalf?

The Shaykh : May Allah bless you, no scholar in the world can say that it is permissible to appoint someone or that it is not permissible. It is he who should seek a ruling for himself, because Allah (Mighty and Majestic) says:
And [due] to Allah from the people is a pilgrimage to the House - for whoever is able to find thereto a way ولله على الناس حج البيت من استطاع إليه سبيلا
[Ali 'Imran 3:97]
So who can say about a person that he is able to perform Hajj or that he is not able to perform Hajj? No one except the person himself. Do you understand me?

The Shaykh : My brother, pay attention. I am now giving you a general ruling. I do not care about the specific person you are referring to, because the answer comes from the afflicted person himself. If he judges that he is not able to perform Hajj to the Sacred House of Allah for one reason or another, then it is permissible for him to appoint someone. But if he is able, then it is not permissible.
