The questioner : May Allah reward the honorableThe Shaykh : My brother resides here in al-Qassim, and his wife will come to perform the obligatory Hajj this year, if Allah wills, from outside the Kingdom. He will go to her and stay with her in Madinah for three or four days. Is there any ruling against him if he has intercourse with her during this period? Please note that she will be in the state of ihram, and he will enter the state of ihram from Abi Arq al-‘Ali on the seventh day of Dhul-Hijjah.

The Shaykh : How can she be in the state of ihram and allow him to have intercourse with her? That is not possible! But if she comes, for example, via Madinah, and her intention is to go to Madinah, she should not enter the state of ihram. This is because it is permissible for a person, for example, coming from Egypt, Syria, or elsewhere, who intends to perform Hajj but wishes to start by visiting Madinah first, to delay entering the state of ihram until he passes by Dhul-Hulayfah after finishing his visit to Madinah.
So we tell this brother: Call her now and tell her not to come in the state of ihram. She should go directly to Madinah. If he meets her there, he may enjoy her company, and then they can both return to Makkah. Yes. And they should enter the state of ihram from Dhul-Hulayfah.
