The questioner : I have a cousin (daughter of my maternal aunt) who is four years younger than me, and I want to marry her. I have learned that my mother nursed her due to an illness that afflicted her mother, and I seek a ruling on the validity of my marriage to her. Please inform us, may you be rewarded?

The Shaykh : Your marriage to her is valid, or in other words, it is permissible for you to marry her, if this nursing did not fulfill the conditions. The conditions for nursing that establishes prohibition are that it be five breastfeedings or more during the period of nursing, meaning within the two years before weaning. The evidence for this is what Muslim narrated in his Sahih from Aisha (may Allah be pleased with her), who said: "Among what was revealed in the Qur'an were ten breastfeedings that establish prohibition, then they were abrogated by five known breastfeedings that establish prohibition".
And his saying (peace and blessings be upon him):
as fostership is only valid if it takes place in the suckling period (before two years of age). إنما الرضاعة من المجاعة
Sahih al-Bukhari 2647
, and in the hadith:
The only suckling (to be considered) is that which gives life to the bones لا رضاع إلا ما أنشز العظم، وكان قبل الفِطام
Bulugh al-Maram 8:199
If this girl, who is your maternal aunt's daughter, nursed from your mother five breastfeedings or more before she was weaned, then she is your sister, and it is not permissible for you to marry her. But if she nursed less than five times, or if she nursed after the two years and weaning, then she is not your sister, and it is permissible for you to marry her. Yes.

The questioner : This is a message from Uthman Muhammad Ali al-Sudani, who says in his message.
