The Shaykh : Another question: I read in the book "The Description of the Prophet's (peace and blessings be upon him) Fasting in Ramadan" by Salim al-Hilali that if a pregnant or nursing woman fears for herself or her child, she breaks her fast and feeds one poor person for each day, and that making up the fasts is not obligatory for her. What is the validity of this statement? We ask for clarification. May Allah reward you with good.
Answer: It is not obligatory for her to make up the fasts; rather, it is obligatory for her to pay an expiation by feeding one poor person for each day. This answer is correct. As for the condition mentioned—that is, if the pregnant or nursing woman fears for herself or her child—this condition is merely the independent legal reasoning (ijtihad) of some scholars, and the pregnant or nursing woman is not required to adhere to it. This is because the Prophet (peace and blessings be upon him) said:
Indeed, Allah (Blessed and Exalted is He) has waived fasting for the pregnant and nursing women. إن الله - تبارك وتعالى - قد وضع الصيام عن الحامل والمرضع
. Then Ibn Abbas interpreted the statement of the Exalted:
So whoever among you is ill or on a journey [during them] - then an equal number of days [are to be made up]. And upon those who are able [to fast, but with hardship] - a ransom [as substitute] of feeding a poor person فمن كان منكم مريضًا أو على سفر فعدة من أيام أخر وعلى الذين يُطيقونه فدية طعام مسكين
[Al-Baqarah 2:184]
. Ibn Abbas (may Allah be pleased with him) said: "The pregnant and nursing women are required to feed the poor." That is, the condition mentioned earlier does not exist; namely, that the pregnant or nursing woman must fear for herself or her child.
