Combining the texts regarding the ruling on drinking while standing, and discussing al-Hafiz Ibn Hajar’s words on the matter.

Machine translationRead the Arabic original
The Shaykh : As I told you on the occasion of drinking while standing, some scholars say: “He prohibited drinking while standing, meaning it is disliked (tanzih).” This is contrary to the original principle, and contrary to the fact that prohibition implies prohibition (tahrim). It is also contrary to the saying: “The Messenger of Allah (peace and blessings be upon him) forbade drinking while standing.” For it is authentic that he (peace and blessings be upon him) ordered the one who drank while standing to say to him:
Vomit, vomit قِئْ قِئْ
. Is this in the category of what is disliked? Meaning, is it contrary to what is preferable? Meaning, does the Messenger (peace and blessings be upon him) burden a person who has transgressed and make him taste the severest punishment for the sake of what? Violating a disliked thing, the dislike of the disliked thing? This is not the way of Islam in dealing with matters.
Yes.

Eid Abbasi : They object. The consensus is that it is not, meaning, an obligation imposed on the person, but rather for the sake of recommendation.

The Shaykh : They object.

Eid Abbasi : Ibn Hajar says.

The Shaykh : That they.

Eid Abbasi : That the agreed-upon position is that the command to vomit
Whoever drinks while standing مَن شرب قائمًا
is on the basis of recommendation, not obligation.

The Shaykh : Glory be to Allah! What was said about that applies to this. How can it be on the basis of recommendation... for the Messenger (peace and blessings be upon him) to [do this to] this person...

Eid Abbasi : It is recommended for him to vomit, but if he does not vomit, he does not sin. This is what he says.

The Shaykh : No, we do not want the fruit right now; we want the way to reach the fruit. How does the Messenger (peace and blessings be upon him) command? Meaning, when the person hears the address from the Messenger:
Vomit قِئْ
, his mind is naturally free of any circumstances that scholars later arrive at. So when he hears
Vomit قِئْ
, what do you think he will do?

Eid Abbasi : He will comply.

The Shaykh : He will comply. Well, this compliance is for the sake of what? Because he violated a disliked thing (tanzih)? Meaning, he did what is contrary to what is preferable? We do not know of such commands in the Shari'ah. Also, it is said: how established is this agreement?
