The ruling on drinking while standing.

Machine translationRead the Arabic original
The questioner : I would like to ask about drinking while standing. The hadiths report that the Messenger of Allah (peace and blessings be upon him) rebuked and prohibited drinking while standing, and ordered the one who drank while standing to induce vomiting. In another narration, it is reported that he drank while standing. Here we have a statement and an action, and the statement takes precedence over the action. Here is the cause: it is reported in one of the hadiths that the cause is that the one who drinks while standing, Satan drinks with him. So now, my Shaykh, how do we reconcile these two hadiths?

The Shaykh : You mentioned three hadiths, so specify now the two conflicting hadiths so that we can reconcile them.

The questioner : How do we reconcile the hadiths that...

The Shaykh : Do not say "hadiths," say "two hadiths."

The questioner : It is confusing. We can reconcile the two hadiths, but the problem comes from the other hadiths. How do we reconcile the hadiths in which the Messenger (peace and blessings be upon him) prohibits drinking while standing with the hadith that says he drank while standing?

The Shaykh : These are the two hadiths you just mentioned, whereas earlier you mentioned the hadith about Satan drinking with you. That is the third hadith. Okay, so now you need to reconcile the hadith prohibiting drinking while standing with the fact that he drank while standing. Is that not it? Okay, you did not reconcile them when you said that the statement takes precedence over the action.

The questioner : Shaykh, if drinking while standing is forbidden according to this view?

The Shaykh : You did not answer me. You did not reconcile them when you said...

The questioner : I reconciled them, but I preferred one when I reconciled them... meaning that is not what I intended in my question.

The Shaykh : The thing you are asking me about, you did it. The thing you want me to answer, you answered it yourself.

The questioner : I intended to ask whether the preference now indicates that drinking while standing is forbidden, or whether it indicates recommendation, as we understood from some...

The Shaykh : Now the question is clear. Is there any other aspect to this besides that hadith? You mentioned a narration:
prohibited drinking while standing نهى عن الشرب قائما
Jami` at-Tirmidhi 1881Sahih (Darussalam)
Do you know
disapproved the drinking of water while standing زجر عن الشرب قائما
Sahih Muslim 2024a
Do you know this narration?

The questioner : I think I read it in al-Sahihah.

The Shaykh : Okay, do you understand the difference between
prohibited drinking while standing نهى عن الشرب قائما
Jami` at-Tirmidhi 1881Sahih (Darussalam)
and
disapproved the drinking of water while standing زجر عن الشرب قائما
Sahih Muslim 2024a
What is the difference?

The questioner : The rebuke here involves severity.

The Shaykh : Okay, so what does the severity imply? Is it disliked or is it forbidden?

The questioner : It is forbidden.

The Shaykh : Also, you gave us the answer. May Allah reward you with good.

The questioner : And to you as well. I mean, if the hadith exists that the Messenger of Allah (peace and blessings be upon him) drank, it does not indicate recommendation, or rather, it does not make the meaning of the first hadith recommendation, I mean, dislike, excuse me.

The Shaykh : No, and then the third hadith regarding
Satan drinks with you شرب معك الشيطان
- may Allah forbid - also confirms the prohibition, because it is not permissible for a Muslim to engage in a cause in which Satan shares with him. So it is not permissible to drink while standing and give Satan the opportunity to drink with him, because he drank while standing. This is another proof of the prohibition of drinking while standing, other than
disapproved the drinking of water while standing زجر عن الشرب قائما
Sahih Muslim 2024a
And I say, pointing out that the default ruling of a prohibition is prohibition unless there is an indicator. Here there is no indicator, but rather here are two indicators that confirm the default, which is obligation or the prohibition that is the opposite of permissibility. It is obligatory to drink while sitting, and what is prohibited is to drink while standing. The prohibition alone has the default of prohibition, and then the prohibition is confirmed by two indicators: the rebuke, and the other is Satan sharing with him, besides that.

The questioner : Our Shaykh, does the one who drinks while standing, if excused, have the fact that Satan drank with him averted from him?

The Shaykh : Of course.

The questioner : The hadith that ordered inducing vomiting for the one who drank while standing, is this hadith authentic?

The Shaykh : It is in Sahih Muslim, but its chain is weak. Yes, indeed.
