The questioner : The questioner says: I swear oaths frequently, and I have read in the Tawhid curriculum for the third year of middle school that frequent swearing leads to shirk (associating partners with Allah) that contradicts the perfection of tawhid (the oneness of Allah). What is my obligation? I swear, and sometimes I do not fulfill the oath. The expiations have accumulated for me, and I forget whether I have paid the expiation for this oath or not? What is obligatory for me in such a situation?
The Shaykh : Allah the Mighty and Majestic said: This verse was interpreted to mean that a person should not frequent oaths. There is no doubt that frequent oaths indicate that a person does not take the oath seriously, even though an oath is a grave matter for which Allah has made an expiation obligatory for whoever does not fulfill what he swore to. Accordingly, we forbid this questioner from frequent swearing. Then we say: If frequent swearing slips off the tongue without intention, a person is not held accountable for it, neither in sin nor in expiation, because it slips off the tongue without intention. Allah the Mighty and Majestic said: [Al-Baqarah 2:225] And in the second verse: [Al-Ma'idah 5:89] This indicates that frequent oaths that slip off the tongue without intention are among the matters Allah has forgiven, and praise be to Allah, Lord of the worlds. I advise this questioner and others to append "if Allah wills" to their oaths, meaning they should say, "By Allah, if Allah wills," so that it is easier for them to achieve their goal and safer from the obligation of expiation if they break the oath. For whoever swears an oath and says, "if Allah wills," there is no breaking of the oath for him. And whoever swears an oath and says, "if Allah wills," it is likely that Allah will make his matter easy. The evidence for this is the saying of Allah, Glorified and Exalted is He: [Al-Kahf 18:23-24] And what is established in the authentic collections from the Messenger of Allah (peace and blessings be upon him and his family): relying on the strength and determination within himself, so that his saying "if Allah wills" does not lead to negligence in this matter, since he knows that if he says "if Allah wills," he will not break the oath. Blessed is the All-Knowing Creator, to show his Lord the Mighty and Majestic that what Allah wills happens, and what He does not will does not happen, and that a person may will something and be determined about it, but it does not come to pass as he desires. The Prophet (peace and blessings be upon him and his family) said: Sahih Muslim 1654b This indicates that if a person swears and says, "if Allah wills," his affairs will be made easy. As for the fact that if he swears and says, "if Allah wills," he does not break the oath even if he contradicts what he swore to, it is because the Prophet (peace and blessings be upon him) said: Bulugh al-Maram 1378 So a person should accustom his tongue, when swearing, to say, "if Allah wills," so that if the matter does not turn out as he wished, he is safe from the expiation. There is no harm in saying it aloud, just as he said his oath aloud, or saying it secretly so that the other person does not hear it.
The questioner : May Allah bless you.
The Shaykh : Allah the Mighty and Majestic said:
And keep your oaths
Allah does not impose blame upon you for what is unintentional in your oaths, but He imposes blame upon you for what your hearts have earned
لا يُؤَاخِذُكُمُ اللَّهُ بِاللَّغْوِ فِي أَيْمَانِكُمْ وَلَكِنْ يُؤَاخِذُكُمْ بِمَا كَسَبَتْ قُلُوبُكُمْbut He will impose blame upon you for [breaking] what you intended of oaths
(23) And never say of anything, "Indeed, I will do that tomorrow," (24) Except [when adding], "If Allah wills."
That the Prophet of Allah, Sulayman ibn Dawud, swore that he would go around to ninety women that night, each of whom would give birth to a boy who would fight in the cause of Allah. It was said to him: Say, "if Allah wills." But he did not say, "if Allah wills"
So he went around to ninety women, but only one of them gave birth, and she gave birth to a half-person
Had he said Insha' Allah (if God so will). he would not have failed
Whoever swears an oath, and then says: "If Allah Wills", he is not held accountable if he breaks it.
