The questioner : He says that he burns what remains from the wheat and barley season every year in order to get rid of some seeds, weeds, and harmful grasses in the wheat crop. He says: But there may be ants, mice, and insects in the ground, so they burn up, and I am compelled to do so. Is this forbidden?

The Shaykh : Praise be to Allah, Lord of the worlds, and I send prayers and peace upon our Prophet Muhammad, and upon his family and his Companions, and upon those who follow them with excellence until the Day of Judgment. Before I answer this question, I askThe questioner : Does he burn the ground after planting to kill the ants and others in it? If this is his intention, then it is forbidden or disliked, according to the opinions of the scholars on that. And if he does not intend this, but rather intends to purify the ground of the shoots and harmful weeds that damage the crops, then there is no blame on him for that, because what burns up of insects and others burns up unintentionally. And I believe that it would be his wish that there were nothing of that in the ground. And it is established from the Prophet (peace and blessings be upon him) that he burned the palm trees of Banu Nadir in Madinah, and the palm trees are generally not free of bird chicks or the birds themselves that take refuge in them at night, and the ground of these palm trees is also not free of small insects, and yet the Prophet (peace and blessings be upon him) burned them. And we have in the Messenger of Allah (peace and blessings be upon him) a good example. So he distinguishes between this intention and that: whoever intends thereby to destroy these insects is one who does what is disliked or forbidden, according to the opinions of the scholars on that. And whoever intends to purify his ground of the shoots and harmful weeds that damage the crops, then he owes nothing, even if the ants and small crawling or flying insects die thereby.
