The Shaykh’s remarks on seeking permission from one’s parents to go out for jihad.

Machine translationRead the Arabic original
The Shaykh : If there are two elderly parents, very old, and they have a son who serves them, and this son is eager, extremely eager, for what? For going out for jihad in the cause of Allah. There is no one else who can take on the responsibility of his parents’ needs and affairs as we have said. I am not saying that he should leave his parents to their circumstances, where they might perish from hunger, weakness, illness, and so on. Rather, we say: consult your heart, as it came in the hadith, and this is its place.
Consult your own soul, even if the people give you a ruling and they give you a ruling. استفت نفسك وإن أفتاك الناس وأفتوك
Sunan ad-Darimi 18:3
Look now, do you have someone who can take your place in attending to your parents’ affairs? If not, then as it came in the hadith,
Stick to them, for Paradise is at their feet. الزمهما فإن الجنة عند رجليهما
there is no one to attend to their affairs and serve them, so in that case, the permission is not required under the previous condition that they are in need of men.

The questioner : ... meaning, I understood from your words that seeking permission is based on the interest, and this is correct.

The Shaykh : Fine.

The questioner : I think in the hadith of 'Abdullah ibn 'Amr ibn al-'As in Ibn Hibban, he asked: "Which deed is best?" He said:
Prayer at its prescribed time الصلاة على وقتها
Then he asked: "Which is next?" He said:
striving in the path of Allah الجهاد في سبيل الله
Sunan Abi Dawud 2486Hasan (Al-Albani)
The Prophet (peace and blessings be upon him) said to him: "Are you commanded to... truthfully?" He said: "By Him who sent you with the truth..." He said: "You..."

The Shaykh : Yes.

The questioner : The Shaykh Ahmad Shakir commented on this matter that the guardians of the orphan seek your permission for every expedition, so it is based on... the need.

The Shaykh : Yes.

The questioner : But I am speaking of a person now whose mother, for example, does not want him to go, and it will affect her psychologically or perhaps physically by his going. So, if he goes... this harm and the existence of disagreement there, are they in need or not? Which one takes precedence? If he goes, does he sin? If he stays, does he sin? How is the precedence determined?

The Shaykh : Okay, so you do not mention the issue of the mother and her need for the son.

The questioner : Yes, which mother? I mean...

The Shaykh : Because I will say, I will return to what I said earlier.

The questioner : Fine.

The Shaykh : Fine.

The questioner : The need, generally, is for a specific action or... specific... or...
Another questioner: Do you allow me, Shaykh? You mentioned that the need for mujahideen there, whether there are individuals or not, is the basis for the ruling on the establishment or the dropping of the individual obligation (fard 'ayn) for individuals or not. Now, there is disagreement regarding this need here. Some say, "We are in need of men, especially the Arabs among them," and some say, "We are not in need of anything except money."

The Shaykh : Fine.

The questioner : So, is there...

The Shaykh : The rule is applied... from everything that belongs to people.

The questioner : ... is there a need here?

The Shaykh : What is best?

The questioner : No... he said, "We..."

The Shaykh : Yes.

The questioner : ... to what is established, it is not possible... the need sometimes... in the actual situation, but it is established so that the issue is not lost, and this is reality, meaning it is like...

The Shaykh : Fine.

The questioner : Some commanders said this need exists.

The Shaykh : Good.

The questioner : Those under him said...

The Shaykh : Good, again, so that the issue is not lost, is that what you say?

The questioner : Or for...

The Shaykh : No, this or leave it for later, so that the issue is not lost.
